Mit Cargo sous terrain (CST) erhält die Schweiz ab 2031 ein nachhaltiges End-to-End-Logistiksystem,
welches privat finanziert ist. Es dient der pünktlichen Lieferung und Entsorgung von Paletten, Behältern
und Paketen. Das emissionsfrei betriebene Netzwerk mit Tunneln und City-Logistik erhöht die Lebens-
qualität der Bevölkerung und stärkt die Wettbewerbsfähigkeit der Wirtschaft. Die CST AG ist im Jahr
2017 aus einem seit 2010 bestehenden Projekt hervorgegangen. Zahlreiche Schweizer Firmen der Bran-
chen Transport und Logistik, Detailhandel, Telekom, Finanzen und Energie sind als Investoren, Aktio-
näre und Projektpartner an der Umsetzung beteiligt.

Die CST AG mit Sitz in Basel und operativen Büros in Olten besteht aktuell aus 30 Mitarbeitenden. Ge-
plant ist bis Ende 2025 eine Verdoppelung. Erste operative Anwendungen der Surfacelogistik und der
IT-Plattform wurden bereits 2021 gestartet und bis heute weiterentwickelt. Der Bundesrat hat am 1.
August 2022 das Bundesgesetz über den unterirdischen Gütertransport (UGüTG) in Kraft gesetzt. Damit
ist der Weg frei zur Umsetzung des Vorhabens. Im Laufe des Jahres 2024 beginnen die Bewilligungs-
verfahren auf den Stufen Bund (Sachplan) und Kantone (Richtplanung).

Head of Legal + Procurement (m/w/d %

In dieser anspruchsvollen Rolle sind Sie direkt dem CEO unterstellt und stellen die juristische Betreu-
ung der CST AG sicher. Sie erbringen die Legal-Services in Zusammenarbeit mit mandatierten An-
waltskanzleien. Zudem verantworten Sie das Beschaffungswesen.

Ihre Herausforderung

  • Sicherstellung der juristischen Belange der Unternehmung, insbesondere bei der Prüfung und Ver-
    handlung von nationalen und internationalen Beschaffungen und Verträgen
  • Funktion als direkte:r Ansprechpartner:in für die Geschäftsleitung und die Unternehmungsbereiche
    für sämtliche rechtlichen Fragestellungen
  • Zusammenarbeit mit ausgewählten Anwaltskanzleien
  • Zusammenarbeit mit funktionsübergreifenden Teams, einschliesslich Rechts-, Finanz- und Fachbe-
    reichen, um vertragliche und rechtliche Risiken zu ermitteln und zu minimieren
  • Entwicklung einer Beschaffungsstrategie als Grundlage für Beschaffungsentscheide
  • Erstellen von Ausschreibungen/RFPs (Request for Proposals) sowie Führung von Direktverhandlun-
    gen mit Unternehmern und Dienstleistern, Vertragsverlängerungen und Vertragsbeendigungen, um
    die wirtschaftlichen, rechtlichen und regulatorischen CST-Anforderungen zu gewährleisten
  • Überwachung der Vertragserfüllung und Durchsetzung der vertraglichen Rechte und Pflichten, ein-
    schliesslich der rechtzeitigen Beilegung von Streitigkeiten oder Vertragsverletzungen
  • Identifizierung und/oder Entwicklung der richtigen Partner, um hervorragende Dienstleistungen,
    Zuverlässigkeit und Konformität zur Unterstützung der Geschäftsanforderungen zu gewährleisten

Unsere Erwartungen

  • Masterabschluss Recht und ausgewiesene Berufserfahrung im Beschaffungsrecht
  • Kenntnisse des internationalen Vertragsrechts einschliesslich eines umfassenden Verständnisses der
    in internationalen Verträgen häufig verwendeten rechtlichen Bestimmungen, Bedingungen und
    Klauseln
  • Mehrjährige Erfahrung in der nationalen und idealerweise internationalen Beschaffung
  • Erfahrung in der Ausarbeitung und Verhandlung komplexer Handelsverträge mit multinationalen
    Unternehmungen und Organisationen (u.a. FIDIC-Verträge)
  • Ausgewiesene Verhandlungs-, Kommunikations- und Sozialkompetenz mit der Fähigkeit, Einfluss zu
    nehmen und einen Konsens zwischen verschiedenen Interessengruppen herzustellen sowie Chan-
    cen und Risiken zu erkennen
  • Fähigkeit, unabhängig zu arbeiten und richtige Prioritäten in einem schnelllebigen, globalen Umfeld
    zu setzen
  • Verhandlungssicherheit in Deutsch und Englisch

Das Rückgrat des Systems bildet ein im Endausbau 490 Kilometer langes Tunnelnetz von Genf bis St.
Gallen und von Basel nach Luzern mit einem zusätzlichen Ast, der Bern mit Thun verbindet. Das CST
SurfaceLogistik-System übernimmt am Stadtrand und in Logistikzentren nahtlos die im Tunnel gebün-
delten und sortierten Warenströme und nutzt Synergien in der oberirdischen Ver- und Entsorgung. Es
entlastet die Städte um bis zu 30 Prozent des Lieferverkehrs und 50 Prozent der Lärmemissionen und
wird ausschliesslich mit erneuerbarer Energie betrieben.
