Background

The full criminal justice system that tackles tiger crime is the collection of institutions charged with the detection, investigation, arrest, prosecution, and adjudication of tiger traffickers: i.e. law enforcement agencies, the prosecution service and the judiciary. Theand other guidance on effective law enforcement highlight the importance of prosecution agencies being adequately resourced and that public prosecutors understand the scale, nature and impacts of tiger trafficking and are motivated to treat tiger trafficking cases as serious crime and strive to obtain adequate penalties in the adjudication of the crimes prosecuted.

In the(2022), TRAFFIC's analysis of tiger trade seizures, especially arrest and prosecution information– available for 914 seizure incidents – revealed that over 2,313 people were arrested for confirmed and suspected engagement in tiger trafficking globally between 2000 and June 2022. About 95% (2,203) of the suspects were arrested in tiger range countries (TRCs), with the highest numbers recorded from India (1,043 individuals); corresponding with the highest number of cases recorded there.

Reported statistics over the number of arrested suspects from India are significantly higher than those from China (374 people) and Indonesia (227 people) – countries that had the highest number of seizures across this period. The perspective changes significantly when looking at publicly documented convictions and penalties: in China, at least 122 people were convicted to serve jail time and 85 people were fined, followed by India (87 jailed, 62 fined) and Indonesia (59 jailed, 51 fined).

Jail sentences ranged between 17 and 72 months within TRCs, with a median of 36 months. Available data from recent years after 2018 show a positive consolidation of jail penalties between a narrower margin months) and especially a higher minimum sentence compared to before (24 months up from nine months previously). Most of the issued fines ranged between USD 490 and USD 5,200.

WWF's Tiger Conservation Strategy to 2034 includes a strategic approach to support an increase in the rate of prosecutions and deterrent sentences from arrests for tiger trade crimes. The analysis of available prosecution information can point to where the criminal justice system may be strengthened through capacity building of law enforcement including evidence collection and management, utilising associated laws such as money laundering, etc, and training of prosecutors and sensitisation of the judiciary. Such analysis can also be a powerful advocacy tool to catalyse change in prioritisation and resourcing in the criminal justice system.

WWF is seeking a consultant to undertake research to gather existing data and fill gaps from court information to provide a comprehensive view of tiger crime prosecutions across TRCs in South-east Asia over the last five years.

Desired Outputs

A draft report (in Word):

Providing an analysis of the proportion of tiger trafficking arrests which have led to charges, prosecutions and convictions, and an analysis of the sentences given, across TRCs in South-east Asia for the last five years.Including case studies of court cases that provide good examples of prosecutorial procedures, e.g. where financial or other crimes are linked to cases, and of cases that demonstrate the gaps and shortfalls in taking forward tiger trafficking crimes prosecutions, e.g. insufficient evidence.Provide recommendations for how prosecutions of tiger trafficking crimes could be improved.

A final written report, in Word, incorporating WWF's feedback on the draft report. This will be published by WWF.

Consultancy activities

Gather existing data available from NGOs for tiger trafficking seizures, arrests, prosecutions, convictions and sentences.Identify and fill gaps in the data through desk-based research, supplemented by queries to government and in-country visits to key courts for review of paper records. This should include data from cases of tiger trafficking from provincial courts, supreme courts and appeals.Analyse data, as per the above outputs.Write a draft report, as per above outputs.Produce the final report, in Word, incorporating WWF feedback on the draft report. Note, the draft report will be circulated to relevant WWF contacts by the Tigers Alive Tiger Trade Leader, and feedback will be collated in one submission back to the consultant two weeks after the draft is provided.Note, the consultant is not expected to do any design work on the final published report, as this will be the responsibility of WWF.
