**Project Context and Scope**
Legal Identity is relevant to a broad range of IOM programmatic areas and constitutes a
cross-cutting theme that runs through IOM’s mandate and programmes. As such, engaging in
legal identity activities has the potential to strengthen IOM’s role in leading the global debate on
migration, mobility, security, and development.
Established in 2021 by the International Organization for Migration (IOM) and the Ministry of
Foreign Affairs (MFA) of the Kingdom of the Netherlands, the “Cooperation on Migration and
Partnerships to Achieve Sustainable Solutions (COMPASS)” works closely with governmental,
intergovernmental, and non-governmental partners to fulfil their commitments towards migrants,
affected populations, returnees, and host communities in accordance with national priorities, as
well as regional and global commitments and migration governance processes.
The programme focuses on systemic changes that are critical to addressing the underlying
causes of migrants’ vulnerability, gender equality, and exclusion, including in humanitarian and
fragile settings; supporting rights-based policies and legislation; equitable access to essential
protection services; strengthening local partnerships for migrant inclusion and social cohesion;
access to legal identity; reinforcing data-driven responses; and influencing social behaviors and
norms.
A new phase of COMPASS is activated from 2024 to 2027, which outlines three key priorities
- specialized protection, localization, and legal identity. The programme is being implemented in
14 countries,, and in the next four years, will strive to find the most effective and sustainable
ways of assisting migrants and promoting their rights, dignity, and well-being, while expanding
support to its partners in achieving their priority objectives in pursuing improved migration
governance.
To assist governments in strengthening their legal identity systems, IOM intends to support
Member States in refining their operational frameworks concerning legal identity systems and
provisional services to migrants, particularly irregular migrants. Determining the legal identity
and registration of irregular migrants is fundamental for safeguarding their human rights and
acts as a prerequisite for accessing basic services like healthcare, education, employment, and
social welfare. This process also mitigates their vulnerabilities to exploitation, such as including
human trafficking and forced labour, and promotes their integration of migrants into host
communities.
Accurate identification and registration of migrants also assist governments in managing
migration flows effectively and implementing appropriate policies and interventions.
Furthermore, ensuring proper legal identity and registration enables consular services to provide
targeted assistance, streamline processes, address legal issues, enhance migrants’ protection,
and foster better collaboration with stakeholders in host countries. This ensures that consular
services fulfill their responsibility of assisting and protecting the interests of their nationals
abroad, including irregular migrants.
To this end, IOM intends to develop Standard Operating Procedures (SOPs) to facilitate critical
decision-making in determining the legal identity and registration of irregular migrants, to be
used by the relevant government authorities. By doing so, IOM anticipates strengthening the
capacity of IOM Missions and Member States to enhance access to registration services for all
individuals, including undocumented migrants and those facing vulnerabilities. Moreover, this
effort is expected to contribute significantly to the streamlined provision of essential protection
services.
The SOPs will be developed based on established global standards and practices governing the
determination of legal identity and registration for irregular migrants, with a specific focus on
scenarios of crisis necessitating rapid response. The SOPs will encompass two primary
components: guidelines for the critical decision-making processes of relevant government
entities engaged in identification procedures, as well as procedures for consular services to
verify identity, alongside providing overarching guidance for the registration of undocumented
migrants. The
